Terms of Use

These Terms govern access to and use of the vFlea marketplace.

1. Acceptance and incorporated policies

By creating an account, checking the acceptance box, or using a feature that requires an account, you agree to these Terms and the Privacy Policy, Prohibited Items Policy, and rules presented within a feature. The Marketplace Safety guidance explains risk-reduction practices but does not create a guarantee. If you use vFlea for a business or other organization, you represent that you have authority to bind it. Do not use transactional features if you do not agree.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter a binding agreement. You must provide accurate, current information; keep your login credentials and authentication codes secure; and promptly update information that changes. You are responsible for activity through your account unless you report unauthorized access. You may not impersonate another person, create accounts to evade enforcement, transfer an account without permission, or use another member’s account.

Account, security, moderation, and transaction-related notices are part of the service and may be sent even when optional marketing email is disabled. You are responsible for maintaining an email address you can access.

3. vFlea is a marketplace venue—not a party to member transactions

vFlea provides storefronts, listings, Wanted posts, yard-sale and flea-market information, search, public questions, haggle and barter tools, Buy Now requests, reputation features, alerts, and private post-acceptance coordination. Unless a separately identified protected checkout expressly states otherwise, vFlea is not the buyer, seller, auctioneer, broker, escrow agent, payment processor, shipper, carrier, authenticator, appraiser, insurer, employer, or agent of any member. vFlea does not take title to or possession of items.

Members decide whether to transact and contract directly with one another. Verification badges, completed-deal counts, moderation, automated screening, featured placement, and feedback are informational signals only. They are not endorsements and do not guarantee identity, authority, legality, quality, authenticity, condition, price, payment, delivery, safety, or performance.

4. Listings, Wanted posts, storefronts, and events

A seller must own an item or have authority to offer it, and must accurately describe its identity, condition, defects, authenticity, quantity, price, availability, delivery choices, and other material terms. Photos must depict the offered item unless clearly identified as an example. Members must choose appropriate categories and tags and may not use misleading titles, hidden terms, keyword manipulation, or deceptive comparisons.

Wanted posts describe a member’s interest and are not a guaranteed commitment to buy. Storefront descriptions, Specials, promotions, and yard-sale or flea-market details must be accurate and not misleading. Event organizers are responsible for permission to hold an event, the accuracy of dates and locations, accessibility, permits, taxes, safety, and compliance with local rules. vFlea may correct formatting or remove stale, duplicate, unsafe, misleading, or unlawful content.

5. Offers, accepted deals, and transaction records

Listings and Wanted posts generally invite members to negotiate. A submitted haggle, barter, or Buy Now request should be made only with a genuine intent to complete the transaction. When members accept an offer, they form an agreement with each other—not with vFlea—based on the accepted amount or barter items and the delivery, payment, and handoff choices they later confirm.

vFlea records offers, responses, accepted terms, status changes, and member confirmations to support the workflow. A site label such as “accepted,” “declined,” “cancelled,” “completed,” “archived,” or “rescinded” records an action taken on vFlea; it does not independently determine either member’s legal rights or resolve a dispute. Members are responsible for reviewing the final details before acting and for preserving any records they need.

6. Payment, fees, taxes, refunds, and commercial sellers

vFlea currently does not collect or transmit transaction payments and does not provide buyer protection, chargeback rights, escrow, or reimbursement. Members arrange payment directly and assume the risks of the method they choose. Sellers set and disclose their own return, refund, and cancellation terms and remain responsible for applicable warranties, consumer notices, receipts, taxes, licenses, and regulatory duties. Buyers are responsible for confirming those terms before payment.

Seller-created Specials are promotional content from that seller, not vFlea endorsements. If vFlea offers a paid service, sitewide advertisement, or featured placement, the price and material conditions will be shown before purchase; placement affects visibility only and does not certify the member or item.

Commercial and high-volume sellers must comply with all business, consumer-protection, product-safety, and online-marketplace disclosure laws that apply to them. vFlea may require identity, tax, bank, contact, or business information; verify it; display information required by law; and suspend selling privileges when required information is missing, outdated, or false.

7. Shipping, local pickup, and barter

Members arrange shipping and pickup directly. Buyers must provide an accurate private delivery destination when shipping is selected. Sellers must disclose the shipping method or quote, package appropriately, and provide accurate tracking information when available. Members are responsible for loss, damage, delays, insurance, prohibited-mailing rules, and carrier claims except to the extent applicable law provides otherwise.

For local pickup, members should use a safe public location when practical and disclose the private pickup point only through the accepted-deal workflow. Each barter participant is responsible for the legality, condition, value, delivery, and shipment of the item they contribute. vFlea does not determine whether exchanged items or cash supplements are of equivalent value.

8. Prohibited items and conduct

You must follow the Prohibited Items Policy and all applicable laws. You may not use vFlea to commit fraud; trade stolen, counterfeit, unsafe, recalled, infringing, or unlawful items; harass, threaten, discriminate against, or exploit another person; manipulate prices, rankings, alerts, reviews, or transaction history; send spam; distribute malware; scrape or harvest data without written permission; reverse engineer or disrupt the service; bypass access, safety, moderation, or security controls; or collect or expose another person’s private information.

Do not publish phone numbers, personal email addresses, precise home addresses, financial credentials, or other sensitive information in public listings, Wanted posts, questions, profiles, or storefronts. Use the private accepted-deal tools only for information reasonably necessary to complete that deal.

9. Member content and intellectual property

You retain ownership of content you submit. You represent that you have the rights needed to submit it and that it does not violate law or another person’s intellectual-property, privacy, publicity, or other rights. You grant vFlea a non-exclusive, worldwide, royalty-free license to host, store, reproduce, reformat, display, distribute, and create technical adaptations of that content solely to operate, secure, improve, and promote vFlea. This license ends when the content is deleted, except for copies reasonably retained in backups, transaction records, moderation evidence, or as required by law.

You may post an honest review based on your genuine experience, including a negative review. You may not submit fake, purchased, undisclosed-conflict, retaliatory, extortionate, or otherwise deceptive feedback. vFlea may moderate feedback for rule violations but will not remove a review merely because it is unfavorable. Product suggestions and other feedback sent to vFlea may be used without restriction or compensation, but this does not transfer ownership of a consumer review.

Use the site’s Feedback or reporting tools to identify suspected infringement and include the work claimed, the content at issue, its location, your contact information, and a good-faith explanation. Formal copyright notice procedures and a designated legal contact must be published before launch.

10. Moderation, investigations, and enforcement

vFlea may use automated signals and human review to prevent abuse. We may refuse publication, hold content for review, remove or limit content, preserve relevant records, warn members, restrict features, suspend or close accounts, cancel promotional placement, or report credible threats or suspected unlawful conduct to appropriate parties. We may act without advance notice when reasonably necessary for safety, security, legal compliance, or protection of the service or its users.

Reporting content does not guarantee removal or a particular result. Members may not misuse reporting tools or retaliate against a reporter. You may use the Feedback link to ask for review of an enforcement decision, but vFlea is not required to restore content or access.

11. Privacy, location, and communications

The Privacy Policy describes collection, use, sharing, and retention of information. Public maps and discovery features use approximate member locations unless an event organizer intentionally publishes an event address. Private shipping and pickup addresses are shared only within the applicable accepted deal, subject to legal and safety disclosures.

Public questions and offer ledgers are not private messages. Private messaging opens only for accepted deals and may be retained for safety, dispute, moderation, and legal purposes. Do not use vFlea as an emergency service; contact local emergency services if anyone is in immediate danger.

12. Third-party services and service availability

vFlea may rely on third-party mapping, email, security, hosting, authentication, and other services. Those providers may have separate terms and privacy practices. Links to third-party sites do not imply endorsement. vFlea may change, suspend, discontinue, or limit any feature and does not guarantee uninterrupted, secure, or error-free availability or permanent storage of content.

13. Disclaimers

To the fullest extent permitted by law, vFlea and its service providers offer the service “as is” and “as available” and disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and quiet enjoyment. vFlea does not warrant that members, content, items, events, transactions, communications, or third-party services are accurate, lawful, safe, authentic, available, or free from defects or harmful components. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, vFlea and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; loss of profits, data, goodwill, opportunity, or use; or loss, damage, injury, or disputes arising from a member, item, event, payment, shipment, pickup, barter, communication, or third-party service. To the fullest extent permitted by law, their aggregate liability arising from the service will not exceed the greater of $100 or the amount you paid directly to vFlea during the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability or non-waivable consumer rights that applicable law does not permit to be limited.

15. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless vFlea and its owners, officers, employees, contractors, and service providers from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your content, items, storefront, event, conduct, transaction, violation of these Terms, or violation of another person’s rights. This section does not require a consumer to indemnify vFlea for vFlea’s own unlawful conduct.

16. Account suspension and termination

You may stop using vFlea and request account closure. vFlea may suspend or terminate access for a Terms violation, risk to members or the service, legal requirement, prolonged inactivity, or discontinuation of the service. Content and records may remain visible or retained where reasonably necessary to complete an active deal, protect members, prevent fraud, resolve disputes, enforce agreements, maintain transaction history, or comply with law. Provisions that by their nature should survive termination—including ownership, licenses for retained records, disclaimers, liability limits, indemnity, and dispute provisions—will survive.

17. Changes to these Terms

The effective date identifies the current version. vFlea may update these Terms to reflect product, legal, or operational changes. Material changes will be presented for renewed acceptance before continued use of account-based marketplace features. Continued use after acceptance of an updated version constitutes agreement to that version.

18. General terms and contact

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign your rights or obligations without vFlea’s written consent; vFlea may assign these Terms as part of a merger, financing, reorganization, sale, or transfer of the service. These Terms and the incorporated policies are the entire agreement between you and vFlea concerning the service, except for transaction terms agreed directly between members.

Use the Feedback link for questions, accessibility requests, safety reports, or operational concerns. The legal operator’s name, formal notice address, governing law, and forum must be inserted and approved by qualified counsel before public launch. These Terms intentionally do not add a mandatory arbitration or class-action waiver before that review.
